Dobratz et al v. Kleen Energy, et al, Filed 2010 in Middletown.
On Superbowl Sunday 2010, Connecticut was rocked by an explosion occurring at a powerplant under construction in Middletown, CT. The force of the blast was felt as far as 80 miles away. The defendants had forced the laborer-plaintiffs to work on the powerplant during a highly dangerous blow out process using natural gas. Even after workers warned supervisors of the risk, and the need to be offsite during this process, the defendants insisted that work continue during this cleaning. The Motive for forcing the laborers to work that Sunday: The defendants had various bonus contracts that were dependent on the facility being completed by certain deadlines. A massive explosion followed killing 5 workers and injuring more than 20. Stratton Faxon represents more than 20 of these workers and more than 40 homeowners surrounding the plant. See OSHA Findings of Misconduct at Plant
The main injuries were brain trauma caused by the massive explosive impact or blast waves. This trauma has led to Chronic encephalopathy in many of our clients. It is not unlike what soldiers experience in Iraq or Afghanistan when exposed to blasts. Unfortunately, these workers were even less prepared having no blast protection.
