Dwyer v. Zink (Filed 2009 in New Haven)
The plaintiff, a UPS driver, was attacked by an unleashed german shepherd mix while delivering a package. The bite caused damage to the plaintiff’s left ankle which makes it impossible for him to drive the standard shift trucks that UPS has in its fleet. Given his lack of education and training in any other area, the injury has devastated his earning capacity. We have brought a vocational economist on board to substantiate that claim which is valued at more than $1,200,000. A recovery here will also be used to repay the employer who has incurred all of the workers compensation payments to date.
In Connecticut, the owner of a dog is strictly liable for any bite unless the bite was do to the teasing or taunting of the alleged victims. There was no such evidence here.
